General Terms of Service for HOSTOWEB

This document (“the Terms”) constitutes the contractual framework governing, without reservation or restriction, all hosting, domain name, connectivity and associated solutions services (hereinafter “the Services”) provided by HOSTOWEB SARL/AU, a Moroccan company registered in the Commercial Register of Fez under number 65903, with its registered office at 10 Rue Lalla Aïcha, Espace Riad Fès, No.16, 3rd floor, Fez (“HOSTOWEB”), to the contracting client (“the Client”).
The purpose of these Terms is to define the respective rights and obligations of HOSTOWEB and the Client regarding the subscription, use, and termination of the Services. They take precedence over any other document, except for a written agreement signed by duly authorized representatives of the parties. Any order or use of a Service constitutes full, complete, and unreserved acceptance of these Terms.
For the purposes of these Terms:
“Resources” refers to all hardware and software capacities (CPU, RAM, I/O, bandwidth, storage, sessions, SQL queries) allocated to a Service;
“Content” refers to all data, files, databases, messages, or streams published, stored, or transmitted by the Client through a Service;
“Incident” means any event affecting or likely to affect the availability, integrity, or security of a Service;
“Force Majeure” has the meaning set out in Article 268 of the Moroccan Code of Obligations and Contracts.
The Client acknowledges having read, understood, and accepted the Terms before subscribing to any Service. HOSTOWEB reserves the right to unilaterally amend the Terms at any time. Updated Terms are published on hostoweb.com and become effective immediately for any new orders, and after a notice period of thirty (30) days for ongoing Services, unless otherwise required by law.
HOSTOWEB provides shared or dedicated hosting solutions, virtual private servers (VPS), physical servers, DNS services, SSL/TLS certificates, software licenses, messaging services, and any related service described on the product page, subject to technical and commercial availability.
The Client is strictly prohibited, directly or indirectly, from:
Spam and Unlawful Prospecting: Sending unsolicited emails, mass commercial messages, or any content considered as spam;
Infringement of Intellectual Property Rights: Making available protected content (music, films, software, trademarks, databases, etc.) without written authorization from the rights holder;
Illegal Speech: Publishing or disseminating defamatory, insulting, hateful, violent, discriminatory, terrorist, or pornographic statements involving minors;
Cybercrime: Any hacking activity, phishing, fraud, malware, ransomware, unauthorized cryptocurrency mining, exploiting vulnerabilities, port scanning, or penetration testing without written permission from the target;
Network Attacks: Preparing, launching, or relaying DDoS attacks, brute force attempts, or any attempt to compromise third-party systems;
Undeclared Anonymization Services: Hosting or using VPNs, proxies, TOR relays, tunnels, or forwarders not expressly approved by HOSTOWEB.
The Client undertakes to use Resources reasonably, fairly, and proportionally. Shared hosting is reserved for websites and applications with moderate traffic; any intensive load (high-frequency API, mass scraping, video encoding, mining, automated testing, etc.) is prohibited and must be migrated to a VPS or dedicated server. HOSTOWEB reserves the right, after written notice when possible, to (i) dynamically limit Resources, (ii) suspend the Service, or (iii) propose migration to a suitable plan.
The Client guarantees that all scripts, CMS, plugins, and dependencies installed are legal, regularly updated, free from known vulnerabilities, and configured according to the editor’s best practices and HOSTOWEB’s published security guides.
The Client remains solely responsible for their Content. HOSTOWEB is neither the publisher nor fully liable as a host within the meaning of Law No. 07-03 on cybercrime but acts as a mere technical service provider. Consequently, the Client indemnifies HOSTOWEB against any third-party claim or ruling related to hosted Content.
In the event of notification in accordance with Law No. 53-05 or a judicial requisition, HOSTOWEB may immediately remove or block access to disputed Content, without compensation or notice.
HOSTOWEB provides a target monthly network and power infrastructure uptime rate of 99.90%. Scheduled downtimes (preventive maintenance) and force majeure events are excluded from the calculation. The Client is responsible for configuring, backing up, and testing the restoration of their data. HOSTOWEB offers paid managed backup options, which are the sole responsibility of the Client to subscribe to.
Any Service is provisioned only after the effective and irrevocable receipt of payment, unless a specific contract or duly signed order form states otherwise. Quotes are valid for fifteen (15) days unless otherwise indicated.
To pay for your order, you may select a payment method from those offered by HOSTOWEB on the payment page.
For CMI payments, the transaction is debited from your account the day after delivery confirmation.
Your multi-channel payments are secured by the Centre Monétique Interbancaire (CMI), which provides a fully secure payment service.
The Client guarantees that they have the necessary authorizations to use the chosen payment method when validating the order.
In the case of payment by credit card, the provisions relating to fraudulent use of the payment method provided for in agreements between the Consumer and the card issuer, and between HOSTOWEB and its bank, apply.
In the event of non-payment in full by the due date:
Automatic suspension of the Service twenty-four (24) hours after the deadline;
Reconnection fee equal to ten percent (10%) of the unpaid amount incl. VAT, with a minimum of 100 MAD excluding tax;
Irreversible deletion of data fourteen (14) calendar days after the due date;
Referral to the collections department and potential civil and criminal proceedings, with recovery costs borne by the Client.
The Client may request early termination of a Service by giving written notice at least thirty (30) days before the due date. Non-payment constitutes implicit termination, without releasing the Client from any outstanding amounts due up to the end date.
Clients benefit from a guarantee to maintain their initial subscription rate, provided renewal is continuous and without interruption.
In the event of a general price reduction, the new rates will automatically apply from the next billing cycle.
Discounts and preferential rates do not apply to the following:
Software licenses,
SSL certificates,
Third-party modules or services,
Technical or related fees.
HOSTOWEB reserves the right to pass on any price increases imposed by its suppliers, in particular regarding software licenses, certificates, or external services. These adjustments will be communicated to the Client within a reasonable period before coming into effect.
The Client has a “satisfaction or refund” guarantee valid for thirty (30) days from the initial activation date of the service.
The refund covers only the unused portion of the service and expressly excludes setup fees, software licenses, and domain names.
Refund terms are as follows:
Payment by Moroccan bank card, wire transfer, or cash: refund as non-refundable credit on the client account.
Payment by international bank card or PayPal: refund as credit or reversal via the original payment method.
Granted credits are neither transferable nor convertible into cash, and may not be exchanged or offset outside HOSTOWEB services.
In accordance with Law No. 09-08 relating to the protection of individuals with regard to personal data processing, HOSTOWEB undertakes to ensure the confidentiality, security, and protection of the personal data collected from its clients within the scope of its services.
Personal data collected are necessary for order management, service provision, billing, customer support, and legal compliance. Data are intended exclusively for HOSTOWEB and are not transferred to third parties, except where required by law or with the client’s express consent.
The Client has the right at any time to access, rectify, oppose, withdraw consent, and delete their personal data. Any request may be addressed to HOSTOWEB SARL/AU – 10 Rue Lalla Aïcha, Espace Riad Fès, No.16, 3rd floor, Fez – or by email.
By accepting these General Terms, the Client gives their free, specific, informed, and unambiguous consent to the processing of their personal data by HOSTOWEB, as described in this article. Such consent is recorded and may be withdrawn at any time as provided above.
The Client is solely responsible for the regular backup of their data. HOSTOWEB declines all liability for data loss outside its managed backup offerings, provided and tested by the Client. The Client undertakes to maintain complex passwords, activate multi-factor authentication where offered, and promptly install security patches.
HOSTOWEB’s liability, regardless of the cause, is strictly limited to the amount actually received for the relevant Service during the last billing month preceding the occurrence of the event giving rise to the claim.
Under no circumstances shall HOSTOWEB be held liable for indirect or consequential damages suffered by the Client, including but not limited to loss of revenue, contracts, customers, reputation, or any third-party claims.
The Client is required, at their own expense, to subscribe to an insurance policy covering all risks related to the operation of their services, including service interruptions, business losses, third-party liabilities, and technical incidents.
Any liability claim against HOSTOWEB must be brought within a maximum period of three (3) months from the date of the event giving rise to the claim. After this period, no claim will be admissible.
HOSTOWEB shall not be held liable in the event of force majeure or any event beyond its control that renders the performance of its obligations impossible or unreasonably difficult, including, but not limited to: natural disasters, power outages, fires, strikes, malicious acts, war, or cyberattacks.
The parties undertake to keep strictly confidential all technical, commercial, financial, or strategic information obtained in connection with the Services, for the entire duration of the contract and for five (5) years after its expiration, except where required by law or court order.
HOSTOWEB retains ownership of all intellectual property rights relating to the tools, software, configurations, documentation, and trademarks made available to the Client, who is granted a non-exclusive, non-transferable right of use for the sole duration of the Service.
The Client may not assign any or all of their rights and obligations without prior written consent from HOSTOWEB. HOSTOWEB reserves the right to subcontract all or part of the Services, while remaining responsible to the Client.
Services are provided for the period selected when ordering. They are automatically renewed for successive periods of the same duration, unless terminated in accordance with Article 8.4. In the event of a serious breach by one party of its obligations not remedied within seven (7) days of written notice, the other party may terminate the contract by operation of law, without prejudice to any damages owed.
These Terms constitute the general framework applicable to all Services offered by HOSTOWEB. However, some Services or products may be governed by special terms or specific contracts, specified in product descriptions, quotes, order forms, or separately signed agreements.
In the event of a conflict between these General Terms and the special terms of a Service, the latter shall prevail solely for the relevant scope.
It is the Client’s responsibility to carefully review the special terms applicable to each Service before subscribing.
These Terms are governed by Moroccan law. Any dispute regarding their interpretation, execution, or validity shall be submitted to the exclusive jurisdiction of the Commercial Court of Fez, even in the event of multiple defendants or third-party claims.
